A predatory law firm (that is currently being sued for racketeering by others), sued us in 2011 for false advertising, stating that homeopathy cannot work. In the last 15 years, 75+ frivolous lawsuits have been targeting homeopathic companies.
In 2014, we won the trial against the firm. An appeal was sent to The San Diego Court of Appeal, and this court is known to be against any alternative medicine. Last week, we received the opinion of the Court of Appeal of San Diego. The decision was filled with errors, sided against us unfairly, dismissed all arguments that were the basis of our win in 2014, and strong case law backing homeopathy from 2003.
If this decision stays, it could wipe out the entire industry and start an avalanche of new class-action lawsuits that will then shut down a lot of companies and practices.
Excerpts from the Court of Appeal's decision:
This is a dangerous situation for the entire industry: manufacturers, doctors, retailers, and of course, patients. The San Diego Court opinion allows anyone with some kind of training in drugs to be called "an expert in homeopathy" as long as they studied "the theory of homeopathy". It also puts the burden of proof on the defendant, not the plaintiff as it should be, and as it's been the law of the land since the King Bio decision in 2003. It would allow a "lack of substantiation" claim against any homeopathic company, meaning plaintiffs do not need to prove the validity of their claim. Just say that homeopathy cannot work. And one single unqualified plaintiff can be certified as a class action representative.
We can still fight, our only recourse now is the California Supreme Court. We need to petition the Court, first to be heard, then to overturn this new decision.
Lawsuits are costly and our small, family-run company has been fighting for 6 years.
