Free Shelley from Guardianship Elder Abuse

The purpose of this campaign is to raise funds for expenses in the case of Shelley Thomson vs. Texas Health and Human Services Commission. The funds will be used to pay legal expenses, personal expenses, and for a  psychiatrist-of-choice to examine and certify that Shelley Thomson is NOT incapacitated. She was labeled as incapacitated falsely and maliciously by the state of Texas. State guardianship fraud is a national scandal. Shelley’s lawyer has made dozens of pleadings in the case, working hundreds of hours free (pro bono) for over a year.  We are seeking $10,000.  

I live in California and am a friend of Shelley Thomson.  She was on the mend from a nutritional deficiency, but the Texas Health and Human Services Commission (HHSC) used her temporary illness as an excuse to abduct her, take her house, her cat, all her money and assets - and move her into an abusive nursing home. Guardianship fraud is rampant in Texas and throughout the US. Under the guise of protection, states target victims for their money, and treat them worse than prisoners.  

Shelley is 77 years old, an intelligent and healthy individual with a professional scientific background and projects in the works. The state declared her incapacitated with no real evidence, which denies almost all her rights. The rights she has left have been abrogated over and over. Her guardian has threatened her with violence. People at the nursing home are being tortured. Shelley’s food has been laced with drugs secretly against her wishes. Food service is poor. The facility is extremely un-hygienic and the staff incompetent. Inspections and fines are slaps on the wrist. A court investigation of the guardianship has gone nowhere.  

Shelley is held prisoner with no right to leave her room, no visitors, and no exercise.


Records are kept from her and her lawyer, who was not even recognized after he signed a contract with her. The state makes it as hard as possible for her to participate in her own defense, and access to competent service providers is non-existent. No mail is allowed out.  

Nursing homes are a hot spot of Covid-19 infections. Shelley is desperate to leave and has a safe place to stay according to Texas law, but the court has been obstructive (they are part of the problem).  She needs a psychiatrist of her choice to reverse the bogus diagnosis that got her committed. The court will not pay for it. 

If Shelley cannot pick her own psychiatrist, Comal County Court at Law #2 has the option of assigning their own, and they will choose the cheapest expert to rubber stamp a denial of capacity once again. Experts hired by the court earn money each time they certify a person as incapacitated. This financial incentive is perverse and keeps the parade of victims moving through the system as they are stripped of their money and assets to feed the state budget.

Shelley is a strong woman but is getting to the end of her rope. Legal maneuvering and outreach to agencies has been futile. Please help! Your donation will go toward psychiatrist expenses, and incidental expenses to help Shelley function and survive, including groceries to replace the malnourished meals she lives on at the nursing home.
