In 2017, Edwin's wife María was diagnosed with Lupus, an incurable autoimmune disease. Due to her medical condition, she is unable to work full time and has been unable to support her family. Their family has had limited to zero income while Edwin has been unjustly deported. They need our help to pay for rent, utilities, groceries and medical costs. On December 3, 2019, Fairfax Police took Edwin García from his wife and three children. They detained Edwin for three months, despite the accusations being recanted within one month of Edwin's initial arrest. He was found innocent of all allegations and scheduled for release on February 27, 2020. His family was ready for him to come home that day.
Instead, ICE transferred Edwin from Fairfax, Virginia to ICA-Farmville -- the immigrant detention center with the most cases of COVID-19 in the country. Edwin himself has tested positive for COVID-19 and has been experiencing symptoms of extreme body pains, fever, fatigue and fainting.
At Edwin's immigration hearing on July 24, 2020, the immigration judge in his case allowed the uncertified, uncorroborated, and unsubstantiated police report to outweigh any and all positive equities. On the basis of the police report alone, the immigration judge failed to find Edwin as a person of “good moral character." Edwin met all statutory guidelines for relief, but he was denied his freedom solely on the basis of “discretion." According to Edwin's lawyer, there was a clear abuse of discretion, and in doing so, Edwin was denied due process of the law.
Edwin has been described as an educated, hard-working man of principle. He is well-known and loved in his community, church, and home. He has lived, worked, and paid taxes in the United States for sixteen years and was the sole provider for his beautiful family.
